These Terms of Use (“Terms”) govern your access to and use of familymaa.com (the “Site”) and the membership services offered by Family Martial Arts Academy (“FMAA,” “we,” “us,” or “our”). By accessing the Site or creating a membership, you agree to these Terms.
1. Eligibility and Accounts
You must be at least 18 years old to create an account. Memberships for minors must be established and managed by a parent or legal guardian, who is responsible for the minor’s use of the Site. You are responsible for keeping your login credentials confidential and for all activity under your account.
2. Membership, Billing, and Cancellation
- Membership fees, billing frequency, and benefits are described at the time of enrollment.
- Paid memberships renew automatically until cancelled. By enrolling in a recurring membership, you authorize us (through our payment processor) to charge your payment method on a recurring basis.
- Cancellation requires at least 30 days’ written notice by email to thuff@familymaa.com. Your membership and billing continue through the 30-day notice period and stop on the cancellation effective date (30 days after we receive your request). For example, a cancellation request submitted on July 17 becomes effective — and billing stops — on August 17.
- All membership fees are non-refundable.
3. Access to Member Content
Membership grants you a personal, non-transferable, non-exclusive license to access member content (including class videos and resources) for your own use. You may not copy, download (except where expressly permitted), record, share, distribute, sell, or publicly display any member content. Sharing your login or member content with non-members is prohibited and may result in termination.
4. Acceptable Use and Community Conduct
You agree to use the Site lawfully and respectfully. In community or messaging features, you will not post content that is harassing, abusive, defamatory, obscene, infringing, or otherwise objectionable. We may remove content and suspend or terminate accounts that violate these Terms.
5. Media Release and Use of Likeness
By becoming a member, you grant Family Martial Arts Academy and Tracy Huff Enterprises — including all affiliated brands and businesses under the Tracy Huff Enterprises umbrella — the ongoing right to use your name, image, photograph, video, voice, statements, testimonials, and likeness in marketing, advertising, promotional, and social media materials, in any medium, without further notice, compensation, or approval. If you manage an account on behalf of a minor, you grant this same permission with respect to that minor. If you do not wish to grant these rights, please notify us in writing at thuff@familymaa.com before participating.
6. Third-Party Tools, Automation, and Chatbots
We use a variety of third-party tools, systems, affiliates, and automation — including chatbots and AI-assisted tools — to operate some (but not all) parts of our business, such as communication, scheduling, payments, and support. We never sell your personal information to third parties. However, these tools, systems, and affiliates are operated by others and are outside our control. To the fullest extent permitted by law, FMAA and Tracy Huff Enterprises are not liable for any failure, error, downtime, data breach, or unauthorized access to or disclosure of information caused by any third-party tool, system, service, or affiliate we connect with or use. By becoming a member, subscriber, or purchaser, you acknowledge and agree to this.
7. Assumption of Risk and Physical Activity
Martial arts and physical training involve inherent risks of injury. Instructional content on the Site is provided for general informational purposes and is not a substitute for in-person, supervised instruction or professional medical advice. Consult a physician before beginning any exercise program. Participation in FMAA classes may require a separate signed waiver and release of liability. By using instructional content, you voluntarily assume all risks associated with physical activity.
8. Intellectual Property
All content on the Site — text, graphics, logos, videos, and course materials — is owned by or licensed to FMAA and protected by intellectual property laws. You may not use it except as expressly permitted by these Terms.
9. Disclaimers
The Site and all content are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the fullest extent permitted by law, FMAA and its owners, instructors, and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of the Site or reliance on its content.
11. Indemnification
You agree to indemnify and hold harmless FMAA and Tracy Huff Enterprises from any claims, damages, or expenses arising out of your use of the Site or violation of these Terms.
12. Termination
We may suspend or terminate your access to the Site or your membership at any time for violation of these Terms or for any lawful reason.
13. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws rules. Disputes will be subject to the courts located in North Carolina.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
